Congress Okays Drug Tests for Unemployment Benefits

WASHINGTON, DC — As part of a deal approved Friday to extend the payroll tax cut and unemployment benefits through 2012, Congress has given its okay to allow states to drug test people applying for those benefits. The move, initially opposed by Democrats, came after the Democratic leadership bowed to Republican pressure in its eagerness to get the bill passed.

Republicans had initially called for drug testing for everybody seeking unemployment benefits, but Democrats balked before backtracking and agreeing to allow testing for those who lost their jobs because of drug use and those applying for jobs in industries where drug testing is prevalent.

It’s worth noting that people fired from their jobs for drug use are fired “for cause” and not laid off for lack of work, and thus are ineligible for unemployment benefits anyway. But the provision allowing for drug testing in industries where it is common could expose hundreds of thousands of unemployed workers to drug tests before they could receive unemployment checks. None of those workers was laid off because of drug use.

The deal effectively moves the burden of drug testing from employers, who freely decide whether they think testing has more benefits than costs, to state governments and their taxpayers — at least in those states that decide to use the new tool. Drug testing is also more likely to be imposed on lower skilled workers than on white collar workers because those sectors are where drug testing is most prevalent now.

Democratic lawmakers downplayed the extent of drug testing about to be foisted on laid-off workers, while Republicans said they would be widespread. The bill requires the Labor Department to draft regulations to determine who will be subjected to drug testing. Those subject to drug testing will be those unemployed workers “for whom suitable work as defined under the state law is only available in an occupation that regularly conducts drug testing as determined under regulations issued by the Secretary of Labor,” a Democratic staffer explained to the Huffington Post.

“I think it’s a small percentage,” Rep. Sander Levin (D-MI), ranking Democratic in the House committee overseeing unemployment insurance, told the Post.

But Republicans cited employer surveys to argue that drug testing would be widespread, with one survey reporting that 84% of employers required drug tests for new hires.

“That’s total nonsense,” said Levin. “No way 80%.”

But while Democrats and Republicans quibbled over how many jobless workers would be forced to endure the intrusive and humiliating ritual, the Drug Policy Alliance was clear and concise in its opposition to the move.

“This policy is a terrible one-two punch to the gut for thousands of struggling Americans,” said Bill Piper, the group’s national affairs director. “Congress has paired a generous taxpayer subsidy for corporations that drug test with a slap in the face for those struggling to find work, feed their families and keep their homes. The American people have a right to be upset over being forced to subsidize the violation of their civil liberties, when they try to access a program that they pay for with every paycheck. Drug testing is expensive and ineffective, and distracts from evidence-based policies that actually reduce the problems associated with drug use and misuse.”

    but it’s unconstitutional to test a senator or congressman ,as decided by the supreme court in 1996 . once more it’s do as we say not as we do, this violates the fifth amendment just some more ripping of the constitution and bill of rights

    What a waste of money but Politicians can become millionaires while in office through insider trading – something anyone else would go to jail for doing – and they still can’t win the war on pot!

    It’s a waste of money! This is a hidden tax on the American Public to fund another Corporation. The new headline for Times should read “We’re all NAZIs now!” Because that’s EXACTLY what this is National Socialism in the guise of  Crony Capitalism.

    Its about time this got passed. Why should I have to stay drug free working while others have been collecting their unemployment money while sitting home doing drugs not even looking for a job. These people do exist. I see them everyday

      Where, do you see them? Do you think someone with kids and getting $800 a month in unemployment benefits can really afford to do drugs of any sort. This is a really bad law that’s going to raise the cost of unemployment exponentially. Do you think those tests are cheap? I don’t drug test potential employees because of the costs. I do however test when someone gets hurt (insurance company’s usually require it). Now they are going to have to raise your income taxes and/or companies unemployment insurance premiums. Not only that, it’s a violation of basic human rights.  You just seem to be jaded that you are not able to do drugs.

        How about requiring all the politicians who make these intrusive laws to have to submit to drug .testing in order to run for any office. Why ar they any different than the common citizen

          I fully agree, Rich…Our elected leaders are on the dole using the taxpayers dime to live extravagantly…They should be tested DAILY for ALL drugs including ALCOHOL!

    The disconnect between happy employees and slavery is going to make the modern slave worker obsolete.  Nobody sane will be working anywhere all we all have left is everyone on adderall hungover drinking coffee at work.    Also notice how they’re only testing for illegal drugs.  You know the untaxed drugs.  I want to vomit all over the constitution.

    How is this humiliating?  I work for a company that drug tests.  In fact every job I’ve ever applied for in the past 20 years, tests for drugs.  Why not drug test someone before you give them government funds?  It might force some people into rehab if they need it….

      Are not the people in Congress receiving government funds? Why are they not included in the testing? And why aren’t “legal” drugs being tested for? If one of them turns up positive for pain killers, let them produce the pharmacy-filled bottle immediately.And, THC stays in the system for as long as 90 days after the last use. Meth, cocaine, crack all are out of the system after 72-96 hours.
      Personally, I would rather work with someone who smoked marijuana the night before than with someone who drank alcohol, used speed, or is on a daily regimine of pain killers.

    What kind of drugs are you taking?  Of course people addicted to drugs may spend all their $800 of unemployment on them even if they have kids to feed, that’s why it’s called addiction.  If it wasn’t addictive, it most likely would not be a problem with society.  They aren’t saying employers have to drug test, so if you don’t want to you don’t have to.  But you and me are footing the bill regardless if people on unemployment aren’t using the funds to find work and feed their kids, but sitting home doing illegal drugs …

    Honestly, I think it’s ridiculous for employers who most of their employees sit in a cube working on a computer do drug testing, because all they have to do is fire someone if they aren’t doing their job well….. but we all pay the costs for unemployment benefits to everyone.

      I live in the world of the disabled and unemployed, and I also live in one of the least expensive places in America’s mainland to live.  I have been for 20 years!  I have seen these people struggle, and I have seen addicts who pass their urine screening every time by stopping the use of their ADDICTIVE drug of choice 3 days before testing.  I have also seen people be denied jobs and public assistance because they smoked a joint at a friends party LAST MONTH!  Do you get what I’m saying?  These tests are pointedly against the casual user, and favor the junkie due to drug of choice!

    We pay into this….THIS is just other way for the Repubilcans to get into our lifes..stop this abuse of power, drug test the repubilcans  lets see how many of them use drugs,  alcohol is a drug too….I dont drink or do drugs but i rather have some body smokin pot than drinkin..
